ABSTRACT
Introduction
Using 24 case studies, this paper will present the experience of Muslim teachers and practitioners of medicine in South East Asia in the period 1995-2008 in teaching and using the theory of purposes of the Law, maqasid al shari’at, as the basis for ethico-legal reasoning in resolving ethical dilemmas they confront in their daily practice. The experience started at the newly established Kulliyah of Medicine of the International Islamic University in Malaysia. The experience has been adopted by other Malaysian and Indonesian faculties of medicine and they have integrated it in their curricula.
Theory of medical ethics
A medical intervention or non-intervention is considered ethical and legal if it is in conformity or does not violate the 5 higher purposes of the Law which are: preservation of diin, hifdh al ddiin; preservation of life and health, hifdh al nafs; preservation of progeny, hifdh al nasl; preservation of human intellect, hifdh al ‘aql; and preservation of resources, hifdh al maal.
Principles of medical ethics
In practical application apparent contradictions between and among the maqasid can occur for example in the intensive care unit the purpose of life may contradict the purpose of resources. Recourse is made to the principles of the Law, qawa’id al fiqh, to resolve such issues. These principles are axioms that enable quick reasoning out of complex ethico-legal issues. The five grand axioms, al kulliyaat al khams and are: the principle of intention, qa’idat al qasd; the principle of injury, qa’idat al dharar; the principle of difficulty, qa’idat al mashaqqat; and the principle of custom / precedent, qa’idat al ‘urf.
Comparative study of Islamic and European medical ethics
Islamic Law is comprehensive whereas secularized European law denies moral considerations associated with ‘religion’. Medical ethical issues are referred to Islamic Law and Muslims did not develop a separate discipline on ethics. On the other hand Europeans had to develop the field of ethics because their secularized law could not resolve the ethical dilemmas of modern medical technology. The Islamic approach to ethics is simpler and more robust. There is one Islamic ethical theory, maqasid al shari’at, whereas Europeans employ several theories none of which on its own can resolve all problems. Islam has only one ethical theory, the theory of the higher purposes of the Law, maqasid al shari’at. The 4 basic European ethical principles (autonomy, beneficence, non malefacence, and justice) can be shown to fit only under one of the 5 Islamic ethical principles, the principle of injury, qa’idat al dharar.
Conclusion
The paper concludes that Islamic grounding of medical teaching and practice, al ta’asiil al islami li al tibb, is motivation for independent research and application of knowledge in the ummat.
